Terms of Use for the Neurodiversity Gifts Course
and/or National Empowerment Center School
1. Introduction
These "Terms of Use" (the "Terms") constitute a legally binding agreement between you ("Student," "User," "You") and Joshua Roberts, trading as "Inspired Mind Mental Health," and the National Empowerment Center ("We," "Us," "Our"), regarding your use of the "Neurodiversity Gifts" course on Teachable (the "Course"). This also applies to the National Empowerment Center’s Teachable platform more broadly, referred to as the “School.” By enrolling in the Course and/or School, you agree to be bound by these Terms. If you do not agree to these Terms, please do not enroll in the Course.
2. Liability Waiver
You acknowledge and agree that Joshua Roberts, Inspired Mind Mental Health, and the National Empowerment Center, along with their respective employees, agents, and representatives, shall not be held liable for any claims, demands, damages, injuries, losses, or expenses, whether direct or indirect, arising out of or in connection with your participation in the Course. You hereby waive any and all claims against us related to your involvement in the Course.
3. Refund Policy
We offer a refund for your enrollment in the Course under the following conditions:
- Refund requests must be made within two weeks of signing up for the Course.
- Refund eligibility will be considered on a case-by-case basis.
- Only valid reasons for refunds will be considered.

4. Code of Conduct
We expect all students to adhere to a code of conduct that promotes respectful communication and behavior within the Course. Any violation of this code of conduct may result in the termination of your enrollment in the Course.
5. Intellectual Property
All materials provided in the Course, including but not limited to text, graphics, videos, intellectual property, and other content, are protected by copyright and may not be reproduced, distributed, or used without our explicit written permission.
6. Dispute Resolution
Any disputes arising from or relating to these Terms or your use of the Course shall be resolved through arbitration in accordance with the rules of the American Arbitration Association.

8. Notification of Changes

9. Governing Law
This agreement is governed by and interpreted in accordance with the laws of the State of California, without regard to its conflict of law principles.

These Terms constitute the entire agreement between you and us, supersedes any previous agreements, and may not be modified except in writing.
11. Privacy and Data Usage
By enrolling in the Course, you grant us permission to use comments, artwork, or other contributions you make during the course for marketing and promotional purposes, which may include featuring your work on our website or in our marketing materials.
12. Intellectual Property License
We grant you a limited, non-transferable license to use the course materials for personal use only. Redistribution, commercial use, or any other unauthorized use of course materials is strictly prohibited.
13. Terms
By accessing this School, you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this School are protected by applicable copyright and trademark law.
